Welcome to Noveltygift.shop ("Site"), operated by Novelty Gift Seed ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the Site and purchases. By accessing or using the Site, you agree to these Terms, including our Privacy Policy, Shipping Policy, and Refund Policy below. If you do not agree, do not use the Site. We may update these Terms, effective upon posting.

1. Eligibility

You must be 21+ to use the Site or purchase products. We may verify age and cancel orders if you are under 21 or provide false information.

Use the Site for personal, non-commercial purposes only. Do not:

  • Use it illegally.

  • Interfere with Site functionality.

  • Use automated systems without consent. We may suspend or terminate access for violations.
     

3. Products

We sell novelty items, including collectible seeds and apparel, compliant with applicable laws (e.g., 2018 Farm Bill). Seeds are sold as souvenirs, not for germination or cultivation. Product descriptions are informational; we do not guarantee accuracy. You are responsible for ensuring legal compliance in your jurisdiction.

4. Orders and Payment

Orders are subject to acceptance. Provide accurate information during checkout. Payments are processed securely via a compliant third-party processor. Transactions are in USD, excluding taxes and fees, which you are responsible for. We may refuse or cancel orders for any reason.

5. Shipping Policy

  • Methods: Standard and Expedited options, costs shown at checkout.

  • Processing: 1-3 business days.

  • Delivery: USPS (3-7 days Standard)  No Expedited or International for seeds

  • Address: You must provide accurate addresses; we are not liable for errors.

  • Tracking: Provided via email; limited for some international shipments.

  • International: You are responsible for customs duties and legal compliance. No refunds for seized packages.

  • Lost Packages: Contact noveltygiftseed@ gmail.com within 30 days (45 for international) for investigation.

  • Risk of Loss: Transfers to you upon carrier handover.
     

6. Refund Policy

All sales are final. No returns or exchanges due to product nature. Refunds or replacements may be issued at our discretion for:

  • Non-delivery (after investigation).

  • Defective apparel (reported within 7 days, proof required). Contact noveltygiftseed@ gmail.com. Shipping and processing fees are non-refundable. No cancellations after confirmation.
     

7. Privacy Policy

We collect personal information (e.g., name, address, payment details) to process orders and improve services. Data is shared with third-party processors and carriers only as needed. We use encryption for security but do not guarantee absolute protection. You may request data access or deletion by contacting noveltygiftseed @gmail.com. Products are sold "as is" without warranties. Seeds are for collection only; germination is at your risk. You must comply with all laws. We are not liable for misuse or legal violations.

 

9. Limitation of Liability

Our liability is limited to the purchase price of the product. We are not liable for indirect, consequential, or punitive damages.

 

10. Indemnification

You will indemnify us for claims arising from your breach of Terms or illegal use of products.
